1. Introduction and Acceptance of Agreement

1.1 Thank you for choosing Travel Dates. We take all efforts to make sure that you have a delightful holiday experience. To avoid any misunderstanding, we request you to read, understand and abide by the below ‘Terms and Conditions’ along with Privacy Policy before you book any tour or holiday or any service or make any transaction with Travel Dates at any of the Travel Dates sales offices or at sales partner or online on Travel Dates's website or any mobile application or otherwise. Once you book any tour or service with Travel Dates, it is understood that you are giving your unqualified consent to accept and abide by the ‘Terms and Conditions’. In case you disagree with any part of these ‘Terms and Conditions’, kindly do not proceed with the booking.

1.2 ‘Terms and Conditions’ extend to all group tours, customized holidays, corporate tours, any other services and products for Domestic, International or Inbound organised by Travel Dates.

1.3 Travel Dates has the final authority on the interpretation of these ‘Terms and Conditions’.

1.4 Travel Dates reserves the right to amend, vary, add, amplify or waive any stipulation, representation, term or condition mentioned in the ‘Terms and Conditions’.

1.5 Under any unprecedented force majeure situation or any changes in Government policy, Travel Dates reserves the right to supersede any part of these ‘Terms and Conditions’ with an alternate and valid enforceable provision.

1.6 Each of these ‘Terms and Conditions’ shall be severable and if any provision thereof is declared invalid, illegal or unenforceable, then remaining provisions nevertheless shall have full force & effect.

1.7 These ‘Terms and Conditions’, together with the other booking related terms/ communication sent periodically, represent the entire agreement between Travel Dates and you.

1.8 There is no agreement between the Company and you until the company has received the initial registration amount/ deposit as the case may be.

2. Description

2.1 These ‘Terms and Conditions’ be called, Travel Dates or ‘Travel Dates Terms and Conditions’.

2.2 These ‘Terms and Conditions’ may also be referred as ‘Rules and Regulations’.

2.3 Travel Dates will be hereinafter referred as ‘Travel Dates’, ‘TD’, ‘the Company’, ‘the organization’, ‘we’, ‘us’ or ‘our’ and its user will be hereinafter referred as ‘Guest/s’, ‘them’, ‘they’, their, ‘You’, ‘Your’, ‘tourist/s’, ‘traveller/s’, ‘client/s’, ‘customer/s’, ‘pax’, or ‘passengers’.

2.4 The website and the mobile applications if any of Travel Dates are collectively referred to as 'Website'.

3. Definitions

3.1 Travel Dates works under the brand name ‘Travel Dates’, therefore, both these names will be considered one and the same and used synonymously therein.

3.2 ‘Website’ means www.traveldatess.com and ‘Web page’ means a page on the Website www.traveldatess.com.

3.3 ‘Brochure’ means a document with tour information in the form of printed brochure, E-brochure, E-itinerary, leaflet, booklet, travel planner, Tour Price list, Tour Information Email e tc.

3.4 ‘Tour’ means any Domestic/ International/ Inbound Tour organized by Travel Dates.

3.5 ‘Group Tour’ means number of guests booked on any scheduled tour comprising minimum 15, 20 guests for Indian tour and 30 guests for international tour. Number can vary.

3.6 ‘FIT’ means Free Independent Travel and ‘GIT’ means Group Inclusive Tour.

3.7 ‘Corporate Tour’ means a special tour designed for corporates, industries, institutions, independent organisations, ad-hoc groups or individuals to facilitate their meetings, incentives, conferences, exhibitions, seminars, team building and other events. This segment is also known as MICE i.e. Meeting. Incentive. Conference. Exhibition.

3.8 ‘Customized Holiday’ means a tailor-made holiday designed as per the requirements of an individual guest. This segment is also known as FIT.

3.9 ‘Inbound’ or ‘India Inbound’ means tours, packages or any service provided to foreign nationals or non-resident Indians to explore the states of India and the Indian Subcontinent.

3.10 ‘Speciality Tour’ means a group tour designed to meet special interest of travellers which include but not limited to Honeymoon Special, Women’s Special, Seniors’ Special, Singles’ Special, Short Trips, Cost Saver, Festival Tours, Adventure Tours, Trekking Tours etc.

3.11 ‘Sales Partner’ means Travel Dates’s authorized travel agent who possess the requisite licenses, permissions, expertise and infrastructure to sell the tour/s organised by Travel Dates to all the prospective guests. These include sales channels such as PSPs i.e. Preferred Sales Partners; KSPs - Key Sales Partners, OSP - Overseas Sales Partners and franchisees.

3.12 ‘Travel Advisor’ means Travel Dates’s authorized sales person who assists and guides guests on booking their Travel Dates tour/service.

3.13 Associate/ Destination Management Company (DMC) / Contractor/ Supplier/ Vendor means a service provider of a tour or package which includes but not limited to airline, cruise, railway, road transport, hotel, restaurant, caterer, sightseeing attraction, entertainment park etc.

3.14 ‘Tour Manager/ TM / Tour Leader/ Tour Escort / Tour Assistant/ Main Hoon Na’, is a person designated by Travel Dates to conduct the tour as per the itinerary. S/he will also assist or guide the guest/s during the tour.

3.15 ‘Guest/s’ means all the tourists, travellers, vacationers, sightseers, visitors, backpackers, customers, clients who have registered their names or enquired about tour/ package or booked the tour by making part or full payment for any scheduled tour, customized package or any other travel related service provided by Travel Dates.

3.16 ‘Gender’ - The masculine gender shall also include feminine gender and vice versa, the singular shall include plural and vice versa and shall include grammatical variations if any.

3.17 ‘Tour price’ means the price mentioned in the Tour Price Grid on the website/ mobile application/ sms/ email/ Whatsapp/ brochure / E-brochure/ leaflet/ advertisements on print, electronic and social media etc. which is to be paid by guests for booking the tour. Taxes, surcharges, if any, are payable over and above the Tour Price.

3.18 ‘Child’ means a guest who falls below the age of 11 years.

3.19 ‘Infant’ means a guest who falls below the age of 2 years.

3.20 ‘Extra bed’ or mattress means an additional roll-on mattress on floor in twin/ double bed room.

3.21 ‘Surcharge’ means an additional fee/ charge/ tax over and above the initially quoted tour price which is due to peak season/ special event, charged by the associates/ suppliers/ contractors/ tourism or government authorities.

3.22 ‘Peak Season’ and ‘Super Peak Season’ are the seasons of the year where the demand surpasses the supply which results in overall cost increase. This includes but is not limited to Summer Vacation, Diwali Vacation, Christmas Vacation, New Year Holidays, any Country Specific Vacation/ Festival or National/International Events etc.

3.23 ‘First Day/ Last Day/ Day’ of the tour shall start at any time (i.e. in the morning / afternoon / evening /night/ midnight) at the first destination depending on the arrival of the respective flight/ train/ cruise or any other mode of transport and the same shall be in case of the last day of the tour. In other words, a 'Day' of the tour shall mean a part of the day or 24 hours or its part thereof.

3.24 ‘Meal Service’ on tour comprise of pre-set breakfast (B)/ lunch(L)/ dinner(D) and/or any other snack and mineral water bottle as mentioned in the itinerary.

3.25 ‘Jain Meal’ on tour means food without onion & garlic served at Lunch and Dinner as per the tour itinerary, not necessarily before sunset. It may be a buffet service or a table service.

3.26 ‘VISA’ means ‘Visitor’s International Stay Admission’ is a conditional authorization granted by the immigration authorities of a territory to foreigners allowing them to enter, remain within, or to leave that territory for a specified period of time. This is in the form of a paper authorisation or a stamp/sticker endorsed on the applicant’s passport. Travel Dates is a facilitator and does not have any role in the granting / rejecting of the Visa.

3.27 ‘Force Majeure’ means an event or circumstance not within the control, directly or indirectly, of Travel Dates in its ability to perform its obligations/ responsibilities regarding the tour, including

  1. war, hostile invasion, act of foreign enemies;
  2. rebellion, revolution, terrorism, insurrection or civil war;
  3. political unrest, government orders, riots, commotion, disorder,      curfews, strikes, lockouts etc.;
  4. any act or omission of any government instrumentality;
  5. a change in legal requirements;
  6. infectious diseases, epidemic, pandemic;
  7. explosion, fire, flood, drought, tsunami, earthquake, volcanic      eruption, hurricane, tempest, typhoon, cyclone, snowstorm, thunderstorm,      landslides and other exceptional natural calamities and acts of God;
  8. ionizing radiation or contamination by radioactivity from any      nuclear fuel/ waste or radioactive toxic explosive of any nuclear      assembly;

3.28 ‘Cancellation Policy’ means a policy laid down in Travel Dates’s ‘Terms and Conditions’ wherein applicable cancellation charges are specified which are to be borne by the guests on cancellation of their tour.

3.29 ‘Cancellation Charge’ means a charge borne by the guest upon cancelling their tour for any reason whatsoever.

3.30 ‘Refund’ means repayment of the sum of money to the guest paid by him/her at the time of booking the tour after deducting the applicable cancellation charge.

3.31 ‘Future Tour Voucher’ (FTV) means a credit voucher of a specified value issued by Travel Dates on cancellation of the tour. FTV must be utilized by the guest/s for booking their future tour with Travel Dates within the specified period and as per the agreed terms indicated in the said FTV.

3.32 ‘Tour Transfer Charge’ (TTC) means ‘estimated maximum charge’ that the guest may have to pay if their booked tour is being postponed due to the occurrence of certain unavoidable / Force Majeure situation.

3.33 ‘Operational Expense’ means expenses that Travel Dates has to incur through its normal course of business to conduct its tours and business operations.

3.34 ‘Jurisdiction’ means the geographical area over which a court or government body has the power and right to exercise authority. For any legal matter involving the company, parties hereto agree to confer exclusive jurisdiction to Mumbai Courts / Forums.

4. Booking

4.1 Booking of Group Tour, Customized Holiday, Corporate Tour, Inbound and any independent service through Sales Channels or Online through website/ mobile app:

  1. Any guest who enquires about or purchases any product offered by Travel      Dates through its website, mobile application, branch office, sales office      or call centre agrees to enter into a contract with Travel Dates. A      contract is said to have been executed by both the parties i.e. Travel      Dates and the guest. Once a contract is executed, both the parties are      bound by the ‘Terms and Conditions’ mentioned on Travel Dates’s website/      travel planner/ brochure/ booking form. 
  2. When a guest books the product/ service offered by Travel Dates,      provides his/her information and consent for initiating the booking and      thereafter makes the payment of registration amount, indicates that the      guest is interested in the tour and has read, understood and accepted all      the ‘Terms and Conditions’ mentioned on Travel Dates website/ travel      planner/ brochure / booking form.
  3. In case, the booking formalities are processed by the guest on      behalf of his/her family, s/he is deemed to have been authorized to do so      by his family members after reading, understanding and accepting all the Travel      Dates ‘Terms and Conditions’ mentioned on the website/ travel planner/      brochure / booking form. 
  4. A guest must be eighteen (18) years or above to make a booking with      Travel Dates.
  5. A guest must ensure that all the information provided by him/her      while filling the booking form is accurate, as booking is processed based      on this information. In case of any incorrect information, the loss or      cost incurred for amendment will be borne by the guest.
  6. Travel Dates reserves the right to accept or to decline any booking      of any person/s or cancel the booking without assigning any reason.

4.2 Customized Holiday Booking: 

Travel Dates offers flexibility to the guests who do not wish to opt for the readymade holiday itineraries available on the website. Our Travel Advisors assist such guests to create their customized tailor-made holiday as per their requirement and interest. A non-refundable Holiday Design Fee (HDF) of INR 1500 for India and INR 3000 for World must be paid at the time of enquiry. HDF will be adjusted in the booking amount if the holiday is booked within 10 working days from the date of receiving the same. HDF includes only two free amendments in the itinerary.

4.3 Corporate Tour Booking:

In case of Corporate Tour, along with these ‘Terms and Conditions’, terms of ‘Service Contact’ signed with corporate/ industry/ institution/ independent organisation/ ad-hoc group etc. shall also apply. ‘Service Contract’ is generally signed by the authorized personnel of corporate/ industry/ institution/ independent organisation/ ad-hoc group etc. and the terms are applicable to each member of the tour.

4.4 User Registration on Website:

After booking, guests can register on Travel Dates’s website for their respective tour information. They will be able to login through User ID and Password created at the time of registration. Guests are responsible for maintaining the confidentiality of the password and account, and are fully responsible for all activities that occur under their password or account. In case of any unauthorized use of password or account or any other breach of security, guests are requested to immediately notify tickets@traveldatess.com/ respective Travel Advisor. Guests are also requested to ensure that they have logged out from the account at the end of each session. Travel Dates cannot and will not be liable for any loss or damage arising from failure to comply with this.

4.5 Communication with the Guest:

Any communication by Travel Dates will be made through e-mail, WhatsApp, sms, telecall etc. on the registered legitimate contact details provided on the booking form by the guests and shall be deemed to have been communicated to and received by the guest. Guest’s must ensure that number is valid and messages are checked periodically. Travel Dates is not a mobile network operator and does not guarantee the delivery of sms-text messages/ WhatsApp messages/ email. The guest will indemnify Travel Dates for any action taken by TRAI due to a wrong number/ email provided by the guest for any reason whatsoever.

4.6 Physical and Mental Fitness:

When a guest books the tour or when someone else books the tour on their behalf, it implies that the guest is physically and mentally fit to travel to the particular destination. It is crucial for the guest/s to maintain their health throughout the tour and carry any required medication with a doctor’s prescription. Travel Dates reserves the right to decline the booking or discontinue the guest from the tour if the guest is found unfit to travel, or if their medical condition is causing inconvenience to fellow travellers in the group tour. Any expenses due to health issues arising during the tour shall be entirely borne by the guest, and we shall not be held responsible in any manner whatsoever. Additionally, guests are advised that high-altitude locations in the tour itinerary may pose challenges for any individual irrespective of their age and otherwise normal health condition. Further, Minors, Senior citizen and guest with per-existing medical condition, must consult with their doctors before booking any tour, especially before booking the high-altitude destination tours, to ensure a safe and enjoyable experience.

4.7 Mandatory Health Requirement:

Guests must abide by the mandatory requirements for travel to the destination, such as Vaccination, RT-PCR tests, RAT, e-pass formalities, health checks on arrival/ on tour etc. as per the state or country. These requirements or regulations are subject to change periodically. Any cost incurred for such requirements should be borne by the guests. It will be the sole responsibility of the guest to carry the certificate or test report with them and present it whenever asked for by the officials. Any State or Country or service provider such as Airline, Cruise Company, Railway may decline the entry to a guest/s on medical grounds in such situation the consequences including all kinds of expenses will be borne by the guest. 

4.8 Travel During Pregnancy:

Travel Dates does not recommend travel during pregnancy. The Company does not provide any specialized facilities and/or treatments required for childbirth, prenatal, or early infant care on tour. Guest should consider the risks of traveling where necessary medical care for pregnancy may not be available and may not be reachable in a timely manner to address potential medical complications, problems, and emergencies that can occur during pregnancy.

5. Tour Price, Tour Registration, Payment

5.1 To book any tour/ package/ service, guest must make the payment to Travel Dates by Cheque, Demand Draft, NEFT, RTGS, IMPS, Payment app/ wallets like BHIM, PhonePe, Gpay, PayTM or any UPI ID. All payments should be in the name of Travel Dates only. We support ‘Go Digital’ movement of India and request our guests to make digital payments. Cash payment in INR will be accepted as per the Government of India guidelines along with PAN. Kindly note, outstation cheque is not accepted.

5.2 In case of payments made using Credit Card, Debit Card and Online Transfer, convenience charge of 1.8% shall be levied and will be paid extra by the guest.

5.3 The tour price printed / advertised / quoted to the guests is dynamic. A guest booking the tour early is likely to get the lowest price as communicated / offered by the Company, subject to availability of seats. Similarly, a guest booking the tour at the last minute may be offered high prices or vice versa. This pricing structure has been adopted to get early bookings on tours or for filling vacant seats last minute. Hence it is quite obvious that guests travelling on a same group tour are likely to have paid different tour prices. The Company will not entertain any claim whatsoever on account of the same.

5.4 It is a clear agreement between either parties that the prices quoted in the proposal/ brochure/ website have been calculated based upon the prevailing airline/ hotel/ transport tariffs and applicable taxes thereon. The Company reserves the right to alter or amend the price published on the website/ brochure/ proposal in case of increase in taxes, fuel charge, YQ/YR taxes, visa fee, unprecedented foreign exchange fluctuation etc., which will have to be borne by the guest and to be paid before the departure.

5.5 Tour price does not include government taxes and are to be paid extra. As per government’s current regulations, 5% GST (Goods and Services Tax) is applicable on every tour/package and guests will have to pay the same over and above the tour price. In addition to this, effective from 1st October 2020, government has levied TCS (Tax Collected at Source) on GST inclusive tour/package price of international/overseas travel packages. From 1st October, 2023, The TCS rate is either 5% or 10% up to 7 lacs (% is determined on travellers ITR verification on the government portal) and 20% on amounts above 7 lacs depending on certain requirements. Those guests who have submitted PAN copy, Aadhaar copy and have filed their Income Tax Returns (ITR) for previous two assessment years need to pay 5% TCS up to 7 lacs billing. Those guests who do not possess PAN and Aadhaar or have not filed their Income Tax Returns (ITR) for previous two assessment years, will have to pay 10% TCS up to 7 lacs billing. In case of billing above 7 lacs, guests will have to pay 20% TCS. The TCS collected can be claimed while filing annual income tax returns. The TCS amount will reflect in the Form 26AS of the guest whose PAN card is associated with the booking form, irrespective of the person who has made the payment for the tour/package. Hence while booking guests must ensure that the right PAN card is submitted in order to claim the benefit at later stage. Once the TCS amount is collected from the guest, it cannot be refunded by Travel Dates, as it is paid to government and reflects against the Form 26AS of the guest. The TCS is not applicable in case of corporate/Individuals who possess valid TAN (Tax deduction & collection account number) and provide the same at the time of booking/confirmation of tour/package. Further upon submission of TAN, the Corporate/Individual needs to comply with TDS rules and ensure that TDS is paid in the name of Travel Dates.

5.6 If the guest has booked the tour online, the guest needs to reconfirm and authenticate the information provided at the time of online booking. Company reserves the right, to cancel the booking and forfeit the amount paid in case of any misleading information provided by the guest.

5.7 The registration amount paid at the time of booking is non-refundable and interest free, subject to the Cancellation and Refund Policy. Registration amount differs from tour to tour. For tours where air or cruise booking is required, the registration amount will be higher compared to other tours. Payment of registration amount ensures only registration/ participation in the tour and does not entitle to the guest of any services like air tickets, visas, and hotel accommodation until full payment for the tour has been made by the guest and received by Travel Dates. As per payment guidelines stated on ‘bp@traveldatess.com l tickets@traveldatess.com’ tour price must be paid in full, 30 days before the tour departure; in case if tour is booked within 30 days of the departure date, guests must make full payment of the tour price at the time of booking itself. For any reason if the registration amount is not paid in full at the time of booking, guest will ensure that the balance registration amount is paid within 3 days of booking; else booking stands cancelled.

5.8 Registration Amount- Tour/package registration amount is 70% of the net tour price. It is to be paid within three days of booking the tour/package. 

5.9 Travel Dates reserves the right to cancel the booking, forfeit the amount paid as advance and impose cancellation charges in case of non-payment of full tour price 30 days prior to the tour departure date.

5.10 For Customized Holidays, full payment towards the air ticket and minimum 70% payment towards land package is to be paid for confirming the booking. We reserve the right to cancel your booking without notice if the payment is not cleared by the timeline.

5.11 In case the guest makes tour payment by cheque and the same is dishonoured, a charge of INR 150 + 18% GST will be levied by the Company and borne by the guests immediately. Presently, we do not accept any online payments via international credit or debit cards or any other international transaction methods. If you wish to pay via international card or international money transfer, then please get in touch with our team on +91-9008101580. For such transactions additional transaction charges may apply.

5.12 The guest/ user will not share his confidential information like credit/ debit card number, CVV, OTP, card expiry date, user IDs, passwords etc. with any person including the employees, representatives, sales partners of Travel Dates. If such details are demanded by them then guest/ user must not do any transaction and must immediately inform Travel Dates. Travel Dates shall not be liable for any loss that the guest incurs for sharing the aforesaid details.

5.13 All monies paid by the guest to Travel Dates will be the property of Travel Dates and payable to our Suppliers/ Contractors/ Associates for pre-blocking/ pre-booking and providing the services along with operational costs of the company. Guests agree and acknowledge that such monies will not be held by Travel Dates on behalf of the guest.

6. General Inclusions in Group Tour (GIT)

6.1 Any group tour of Travel Dates generally includes –

  • Airfare (wherever applicable).
  • Accommodation.
  • Transport.
  • Meals as mentioned in the itinerary.
  • Sightseeing as mentioned in the itinerary.
  • Tour Manager services.
  • Visa Fees of Indian Nationals excluding ‘Gratis Visas’/ on arrival      free visas/ free visa.
  • Driver and guide tip.

This list is illustrative and not a complete list and includes all the other inclusions as mentioned in the itinerary of the respective tour.

6.2 General Exclusions in Group Tour (GIT) -

  • Gratis/ free of cost Visas which are not included in the tour      price.
  • Expense of any personal nature such as porterage, laundry,      telephone charges, shopping, beverages, additional mineral water or food      which is not a part of the pre-set menus.
  • Courier charge for any specific requirement.
  • Any transport charge (unless mentioned) to reach the reporting      point of the tour and onwards from the dropping point of the respective      tour.
  • Expense incurred in case of discontinuation of the tour for any      reason.
  • Additional expense incurred for any unforeseen circumstance like      scheduled flight cancellation, unscheduled accommodation or for any force      majeure situation.
  • Any increase in government taxes, fuel surcharges, YQ taxes,      airfare, airport development fee, transport charges, visa fees,      sightseeing charges etc.
  • Additional charge for pre or post air ticket deviation from the      scheduled tour programme w.r.t. date or sector.
  • Any excess luggage charge levied by the airline/ cruise/ rail/      transport company.This list is illustrative and not a complete list and      includes all the other exclusions as mentioned on the website/ brochure/      itinerary of the respective tour.
  • 6.3 Any upgradation charge towards first class, business class,      premium economy, seat selection, separate vehicle, room category change      etc. levied by the associates like airline/ cruise/ rail/ hotel/ transport      company in not included in the tour price and guest will have to pay the      same in addition to the tour price.

7. Payment Options

  • 7.1 Travel Loan:

  1. Bank and financial institutions give travel loan on EMI basis.      ‘EMI’ means the equated monthly instalment of amount payable by the guest      to the respective bank/ financial institution/ issuer comprising principal      amount, interest and other charges, if applicable.
  2. The EMI facility being offered by the bank/ financial institution/      issuer to the guest/s, is governed by the respective terms and conditions      of each bank/ financial institution/ issuer and the guest is advised to      approach them in case of any enquiry, complaint or dispute about the EMI      transaction.
  3. For availing the EMI facility; down payment, instalment, interest,      processing fee etc. is charged by the respective Bank/ financial      institution/ issuer as per their policy.
  4. In case of tour cancellation, Travel Dates will charge cancellation      charges as per the Cancellation Policy and Bank/ Financial Institution/      issuer shall process the refund (if any) after deducting the cancellation      charge.
  5. Bank/ financial institution/ issuer is at their sole discretion in      providing EMI facility to guest/s and Travel Dates has no role to play in      the approval, extension, pricing, modification, pre-closure, closure or      any matter incidental thereto pertaining to the EMI facility.
  6. Travel Dates shall not be held liable for any dispute arising out      of or in connection with such EMI facility between the guest and the Bank/      Financial Institution/ issuer.

7.2 Credit Card EMI:

  1. Credit card holders can avail Equated Monthly Instalments (EMI)      facility through their bank, for their tour payment.
  2. Bank is at its sole discretion in providing this EMI facility to      their user and Travel Dates has no role to play in the approval,      extension, pricing, modification, pre-closure, closure or any matter      incidental thereto pertaining to the Credit Card EMI facility of the      guest.
  3. Travel Dates shall not be held liable for any dispute arising out      of or in connection with such Credit Card EMI facility between the guest      and the bank.
  4. In case of tour cancellation, Travel Dates will charge cancellation      charges as per the Cancellation Policy and shall process the refund, if      any.

8. Tour Price Discount Policy

8.1 Discount/ Saving/ Benefit on tour price is at the sole discretion of Travel Dates. The discount strategy for validity/ amount/ percentage/ number of seats/ dates/ age group/ category/ full payment/ part payment/ registration amount/ early booking/ last minute booking/ group booking etc. is defined and controlled by Travel Dates and it reserves the right to make changes in the discount policy at any point of time without assigning any reason. Any discount/ saving/ benefit offer is always valid for limited period, limited tours, subject to availability and may be withdrawn at any time without notice.

8.2 If guest does not fulfil the conditions of the discount like making full payment within timeline or submitting guest/s details/ documents in stipulated time or failing to meet the prescribed guest count for the respective discount etc., the discount facility will be withdrawn and the tour will be re-priced for the respective guest/s and guest will have to honour and abide by the same.

8.3 Provision of any complimentary service/ item, for the tour/ guests is at the sole discretion of the company. Travel Dates reserves the right to revoke/ amend/ discontinue any such service/ item, at any time without prior notice. Any complimentary snack/s provided by Travel Dates on tour are manufactured, packed and supplied by the respective vendors/ suppliers. Travel Dates acts as a facilitator and is not responsible for any defect or damage in this regard and not liable to compensate for any consequences.

8.4 To get early bookings, Travel Dates may offer benefits to guests and ‘free experience’ on tour is one of them. This benefit is generally available on selected tours and for selected guests who book within the promotional timeline. On a particular tour few guests may get the free experience whereas the guests who are not eligible for the free experience, may purchase the same at an additional cost subject to availability. Providing free experiences is at the sole discretion of the company. Travel Dates reserves the right to revoke/ amend/ discontinue such ‘free experience’ if the guest count for the same falls below a prescribed number to operate the same.

8.5 Any discount or benefit offered in any advertising campaign is part of or supported by the marketing budget of Travel Dates and guest shall not question, compare or contest the same. It is not encashable or refundable in any manner whatsoever.

9. Foreign Currency Component (Forex) in Tour Price

9.1 For international tours, tour price includes both Indian rupees and foreign currency component (Forex), which is to be paid from traveller’s Basic Travel Quota (BTQ) at the prevailing Rate of Exchange (ROE).

9.2 Forex component in the tour price can be paid in following ways:

  1. Guest can pay in Indian rupees at prevailing foreign exchange rate      (selling rate)
  2. Guest can pay in respective foreign currency as per the prevailing      Forex Rate (Selling rate) by availing currency from Travel Dates Forex      Private Limited/ Authorized FFMC /Bank.
  3. Guests can pay in respective foreign currency by guest’s own card.
  4. The family head or any immediate family member travelling or      accompanying on the same tour can pay for family’s foreign exchange by      card.
  5. Guest cannot use his/ her card for other person’s tour payment.

10. Documentation

10.1 Documents Required for Booking a Tour:

  1. A guest must have a valid photo ID Proof for booking a domestic      tour and a valid passport for booking an international tour. As per the      circular issued under RBI regulations, submission of PAN for domestic as      well as international tours is mandatory. A guest must also submit all the      documents as per the rules and guidelines issued by the respective visa      consulate/embassy.
  2. It shall be the sole responsibility of the guest to hold valid      travel documents and statutory clearances such as passports, visas,      confirmed air tickets, insurance, any medical or legal certificates etc.      to travel on the tour.
  3. If the guest does not possess the documents stated by the      authorities or fail to submit within stipulated time, then the booking      will be cancelled and cancellation charges will be applied.

10.2 Photo Identification:

  1. For domestic tours in India, all guests must carry the photo      identification in the form of Aadhar card, election ID card, PAN card,      driving license and school / college ID card for students as officials may      ask for photo identification at airports, rail stations certain      sightseeing places, safari parks, border area locations etc. and every      guest must produce the same on demand.

10.3 Passport:

  1. For travelling abroad, all guests including children and infants      must be in possession of a machine-readable passport valid for minimum of      180 days from their tour return date, along with the applicable visas.      Guest must check all the details of their passport for accuracy like name/      address/ validity/ expiry date/ blank pages for visas etc. Guests booking      Europe tour should ensure that the passport validity is for a maximum of      10 years. Old passports with 20 years’ validity and handwritten passports      are not accepted. Guest should ensure that the passports are well      maintained, its pages are serially numbered and not damaged/ tampered/      scribbled/ stapled/ torn etc.
  2. If any passport related issue leads to tour cancellation, then the      guest is liable to pay applicable cancellation charges. For few tours, Travel      Dates as a facilitator collects guest’s passport and submits to various      private entities or consulates or embassy. Travel Dates does not hold      responsibility and is not liable to pay compensation/ refund/ claim if the      passport gets lost or damaged during this process as it does not have      direct /indirect control on these authorities and their operations.

10.4 Visa (International Tours):

  1. A visa is a mandatory authorization issued by the consulate that      permits the guest/s to enter their country for a limited period of stay.      Guest/s must ensure that they possess valid visas for joining the tour. Travel      Dates is a visa facilitator, who assists guest/s for preparing visa      documents, submitting them & collecting the passports from the      consulate on their behalf wherever applicable. Few consulates send the      passport directly to the guest’s residence.
  2. During the visa process, the consulate may contact guest/s for more      details or call for personal interview, irrespective of all relevant      documents being submitted. Guests must ensure that correct address and      contact details are filled on the visa application form. The decision to      issue visa is at the sole discretion of the respective consulate and Travel      Dates does not have any control on the decision of the consulate and      cannot raise any objection to it either. Guest cannot take any legal      action against Travel Dates on such rejection of visas.
  3. Once the passport is received by the guest from the consulate,      guest must verify the visa copy/ stamp for any error or discrepancy in the      name, gender, passport number, type of entry, validity, date of entry/      exit, duration of stay (as per the tour itinerary) etc. Any discrepancy      must be intimated immediately to Travel Dates’s Travel Advisor. We will      try our level best to get it corrected from consulate, however the company      cannot guarantee the in-time corrective action and will not be responsible      for any consequences arising due to the same.
  4. For Schengen visa of Europe tours, full payment of the tour price      is to be made before processing the visa application. In case of part      payment, sufficient bank balance equivalent to the total tour price must      be maintained at least for six months by the guest/s in their bank      account.
  5. For certain countries, if the valid visa is on the old passport,      then the guest has to carry both, the old as well as the new passport on      tour. For certain countries guests are required to transfer the valid visa      on the old passport to their new passport from respective consulate.      Guests should get it transferred before the tour departure and bear the      cost if any. Guests should keep themselves updated about the prevailing      rules of the respective country/ consulate/ embassy.
  6. If guests possess valid visa for the duration of the tour or wish      to process the visa(s) on their own, then that should be brought to the      notice of the Travel Dates Travel Advisor at the time of booking itself.      In such case guests will be entitled to visa fee reduction.
  7. It is the responsibility of the guest to submit all documents      required for the application of the visa well in advance to Travel Dates.       Guests must take a note that even if they have booked or submitted      their visa documents sufficiently well in advance, few consulates have      restrictions on how early a visa can be applied/ processed before the tour      departure date. Due to the high demand at the consulates or embassies,      visa processing time may be longer than expected. Sometimes even if we      submit the documents well in advance, visas may get delayed and may not be      received before the departure of the tour, in such case if guest cannot      join the tour, then cancellation charges as per Cancellation Policy will      apply.
  8. Guests serving for the nation in high security institutions/      corporations like Bhabha Atomic Research Centre (BARC) or Defence/ Armed      forces or Chemical/ Nuclear Industries, should book their tour early and      apply for the visa well in advance as it is likely to take longer than      usual visa processing time at the consulates. The requirement of their      visa documents is somewhat different than a regular guest. Travel Dates as      a facilitator, shall not be responsible for any consequences or not liable      for any refund to the guest if their visa is delayed or not granted.
  9. If guest has any dispute with the consulate/ embassy and decides to      legally challenge the authority, Travel Dates will not be a party to it      and will be unable to represent anything in that matter.
  10. Any hike in visa fee/ VFS charge / service charge in between the      tour launch and visa application date, must be borne by the guest.
  11. Due to any reason whatsoever, sometimes we may need to apply for an      additional visa other than the visa(s) which are already included in the      tour price. In such case guests will have to bear the additional visa      cost.

10.5 Travel Insurance:

  1. All the guests travelling within India or overseas must possess      Travel Insurance. For international tours, overseas travel insurance is      included in the tour price for the guests below 59 years of age. Guests      above 59 years of age will have to pay the difference in insurance      premium.  This insurance has a limited cover which includes loss of      baggage, flight delays/ cancellation, hospitalization, death,      repatriation, evacuation etc. to a certain extent. Few adventure      activities which are part of the tour itinerary may or may not be covered      in the insurance policy. 
  2. Insurance copy is sent to the guests on their registered email ID      before the tour departure and guests should verify all their personal      details on the same and also be aware of the coverage under policy.       It is mandatory for guests to carry their insurance copy on tour and      present the same to the authorities when asked for. Overseas travel      insurance does not cover any pre-existing disease/s. Guests who wish to      upgrade their travel insurance for more/higher coverage, can do so by      paying an additional premium. Contact Travel Dates Travel Advisor for the      same.
  3. Any guest taking pre or post tour extension should extend the      existing insurance policy by paying the required additional premium      charge. In case of Non-Resident Indians (NRIs) or foreign nationals,      insurance will have to be obtained by the individuals on their own before      joining the tour.
  4. In case of any incident leading to insurance claim, it is mandatory      for the guest to intimate the Insurance Company and Travel Dates within 24      hours.
  5. Overseas travel insurance policy is at the sole discretion of the      respective insurance company. Travel Dates is just a facilitator who does      not have any control over their operations or the claim process. Guests      will have to directly communicate with the insurance company and provide      necessary documents asked for the claim settlement. Any grant or rejection      of the claim will be solely the decision of the insurance company and Travel      Dates is not responsible for the same. Any dispute arising about adequacy      of settlement amount or rejection of claim should be directly dealt with      the Insurance Company by the guests.
  6. Guests travelling to international destinations under Customized      Holidays or Corporate Tours (MICE) will have to purchase their travel      insurance separately on their own either through Travel Dates or any of      their resources.
  7. Foreign nationals or NRI guests arriving in India on an Inbound      Tour or any Group Tour, need to purchase their travel insurance separately      on their own before starting the journey.

10.6 Foreign Nationals or Non-Resident Indians (NRIs):

  1. Foreign nationals as well as Non-Resident Indians (NRIs) who wish      to join Travel Dates’s India or Indian subcontinent tours should possess a      valid visa for the required number of days of the tour and they should      abide by all the laws, rules, and regulations of Government of India/      respective country while undertaking the tour. They must declare their      nationality/ NRI status before booking the tour. Government of India tax      regulations may differ for these guests, kindly contact Travel Advisor for      more details.
  2. These guests must carry all the relevant documents including but      not limited to passport, visa, insurance copy, OCI/PIO card (if      applicable) etc. along with them on tour. Incomplete or missing documents      may lead to denial of entry and guests will have to discontinue the tour      and return on their own. In such cases, Travel Dates is not responsible or      liable for any consequences or expenses. Certain destinations or      sightseeing places may restrict foreign nationals or NRIs as per the      region’s entry regulations or may charge extra fee which is to be paid on      the spot by these guests.
  3. Foreign nationals and Non-Resident Indians (NRI) who wish to join      any other Indian or international tour of Travel Dates should possess a      visa for all the countries included in the tour, and should be valid for      the required number of the days as per the tour itinerary. They should      abide by all the laws, rules, and regulations of respective countries      while undertaking the tour.

  

10.7 Minors

Child safety and protection are of utmost priority. To prevent child abduction, most countries have strict regulations requiring specific documents for visa applications or when children travel. Children under 18 years of age must be accompanied by a parent(s) or a responsible adult for their welfare and supervision, or they must possess a written consent letter from their parent(s) to join the tour. It is the guest's responsibility to supervise their accompanied minors throughout the tour and always be aware of their whereabouts.

Minors under 18 traveling with only one parent must carry a notarized letter of consent signed by the non-traveling parent. If one parent is deceased or the child has only one legal parent, a notarized statement to that effect must be obtained and carried as proof during the tour. Some countries may issue a minor's visa linked to the visa of an accompanying adult, who must travel with the minor. To obtain an unlinked visa for a minor, a No Objection Certificate (NOC) from both parents will be required by the consulate or embassy for the visa application.

Failure to submit the appropriate documentation may result in the cancellation of the tour, for which Travel Dates will not be responsible for any consequences or losses.

  

10.8 Immigration

Holding a valid visa only permits a guest to arrive at the respective country's immigration point. The authority to grant or deny permission to enter that particular country rests solely with the immigration authorities of that country.

Occasionally, a guest may be interrogated, held back, or deported by immigration authorities. In such instances, the guest may miss parts of the itinerary, need to rejoin the tour mid-way, or be required to discontinue the tour. All expenses incurred in such situations will be borne by the guest(s), and Travel Dates will not be responsible for these costs. Furthermore, guests will not be eligible for any refunds or compensations from Travel Dates in such cases.

  

11. Tour Itinerary

11.1 Itinerary Adjustments

Travel Dates endeavors to operate tours precisely as per the original itinerary. The itinerary provided at the time of booking or detailed on our website, brochures, or leaflets is based on available information at that time and is subject to change due to various factors, including state or country regulations, airline schedules, cruise operations, rail or road transport, hotel availability, or sightseeing conditions.

11.2 Right to Alter Itinerary

Travel Dates reserves the right to change, alter, or amend the itinerary before tour departure or while the tour is in progress. Information regarding such changes will be communicated to guests via email, SMS, phone call, or by the Tour Manager during the tour.

11.3 Reasons for Itinerary Changes

Changes to the original tour itinerary may occur due to Force Majeure events (unforeseeable circumstances), fairs, festivals, sports events, adverse weather conditions, traffic problems, cancellation or re-routing or overbooking of flights, cruises, or railways, overbooking or closure of hotels, or closure of sightseeing attractions. Such unforeseen situations may incur additional charges, which guests will be responsible for.

11.4 Sightseeing Modifications

For the enhancement of the itinerary, Travel Dates reserves the right to add, delete, or exchange sightseeing attractions or any other service. If an additional new sightseeing attraction or service requires an extra charge, this cost will be borne by the guest.

11.5 Specific Date/Day Attractions

In some tour itineraries, certain sightseeing attractions or destinations are planned for specific dates or days, such as full moon days, Independence Day, or Republic Day. If, due to any unavoidable reason or political movement, we are unable to visit these attractions or destinations, we will attempt to reschedule the visit for an alternate day. Should a visit not be possible at all, we will endeavor to arrange an alternate sightseeing option or refund the entry fee for the missed attraction.

11.6 Missed Sightseeing/Activities

If any sightseeing place is not visited or an adventure activity is not undertaken due to unforeseen reasons, an alternate sightseeing option may be arranged where possible. If an alternate cannot be arranged and a refund is applicable, it will be processed in INR only.

11.7 Mishaps Affecting Itinerary

Any mishap during the tour may result in an itinerary change.

11.8 Specialized Services (Helicopter, Seaplane, etc.)

Any booked tour, package, or service that includes helicopter, seaplane, cruise, or ferry travel is subject to availability, weather conditions, local body permissions, and any other statutory requirements. Travel Dates is not responsible for any operational deficiencies under any circumstances whatsoever. In unavoidable circumstances, Travel Dates reserves the right to utilize an alternate product, service, or sightseeing option instead of the one advertised or published. In either case, the partnership firm shall not be liable for any damage, additional expense, or consequential loss suffered by the guest(s).

11.9 No Compensation for Unforeseen Changes

Guests should note that itinerary changes often occur due to factors beyond our control. Travel Dates shall not be liable to pay any compensation or damages on account of such changes.

  

12. Joining and Leaving Guest (J/L) (Ex-Destination Guest)

12.1 Definition and Payment

A Joining and Leaving (J/L) or Ex-destination guest is a traveler who books a Travel Dates group tour without availing of our visa, insurance, and main sector air ticket services. These guests arrange their own travel to reach the tour's first destination on day one and depart from the last sightseeing location, restaurant, hotel, or airport on the tour's final day to return to their hometown. J/L or Ex-destination tour payments can be made in INR, USD, EURO, or the designated currency of the respective tour, either at any Travel Dates sales office or directly via electronic transfer.
 

12.2 Required Documents and Transfers

J/L or Ex-destination guests must carry valid air tickets, passports, valid visas, and insurance for the tour. Any airport transfers to and from the tour's starting and ending points must be arranged and paid for by the guest(s) independently.

12.3 Flight Booking Responsibility

Guests should confirm tour specifics such as day, date, time, place, and flight schedule with a Travel Dates Travel Advisor to book their flights accordingly for joining or leaving the scheduled group tour. It is advisable to purchase refundable air tickets. This allows guests to pay a date change fee to the airline and modify their tickets if there is any change in the scheduled tour date. If a guest purchases a non-refundable ticket and a scheduled tour date changes, they will be responsible for purchasing a new ticket to join the tour at their own cost. Travel Dates shall not be liable for any loss or cancellation arising from this.

12.4 Information Sharing

It is mandatory for guests to share copies of their valid air ticket, visa, and insurance with their Travel Advisor at Travel Dates before the tour. Guests should also provide their local contact details and be aware of the reporting place, the name of the Tour Manager, and their active local contact number.

12.5 Additional Services

Any additional services, such as pre/post-tour accommodation, transfers, sightseeing, or meals, will incur extra charges. Such payments must be settled immediately or at least 30 days prior to the tour departure.

12.6 Missed Services Due to Changes

Due to unavoidable circumstances, Force Majeure events, or airline operational changes, we may need to alter the tour sightseeing schedules on the first or last day. In such cases, J/L or Ex-destination guests may miss certain sightseeing activities or on-tour services. Travel Dates will not be liable for any refund for missed sightseeing or services, nor will it provide any compensation for such consequences.

12.7 Reporting Place

J/L or Ex-destination guests must reach the scheduled reporting place (e.g., airport, hotel, sightseeing location) at their own cost, as advised by the Travel Advisor or Tour Manager. If a guest is unable to join the tour at the pre-decided reporting place, the group will proceed as per the itinerary, and the guest will be responsible for joining them at a later point and bearing any associated expenses.

  

13. Deviation Guest

13.1 Definition

A Deviation Guest is a traveler who books a Travel Dates group tour but opts for a deviation from the scheduled itinerary, either before or after the tour, for reasons such as visiting friends or relatives, attending a convocation or convention, or a business visit.

13.2 Informing and Charges

If a guest wishes to travel in advance (pre-deviation) or return at a later date (post-deviation), they must inform their Travel Advisor at the time of booking. The Travel Advisor will guide the guest regarding necessary changes to various services, including airline date/sector changes, visa extensions, additional service modifications, insurance validity, and additional accommodation or transfers. There will be additional charges for these required changes, which must be paid by the guest immediately. 

  

13.3 Subject to Availability

Deviation requests are subject to availability. If the requested change is not available, the guest will need to choose from alternate options.

13.4 Flight Re-confirmation

It is the guest's responsibility to re-confirm their air ticket and flight schedule 24 hours prior to departure.

13.5 Joining/Leaving on Own

If a guest undertakes any pre or post-tour deviation independently, it is their responsibility to join or leave the tour at the designated airport, hotel, or sightseeing location at their own cost, as advised by the Travel Advisor or Tour Manager. Should a guest be unable to join the tour at the pre-decided reporting place, the group will proceed as per the itinerary, and the guest will be responsible for rejoining them at a later point and bearing any associated transport expenses.

13.6 Document Verification

These guests must verify their air ticket, visa, and insurance for correct travel dates and validity before the tour's departure.

13.7 No Guarantee or Responsibility

Deviation is a guest's request, and while Travel Dates can assist, we do not guarantee its feasibility and will not be held responsible for any consequences arising from such deviations.

  

14. Post Tour Holiday

14.1 Option for Extension

Travel Dates offers a Post Tour Holidaypackage, allowing guests to extend their holiday after completing the scheduled group tour in the same city or country, or at a destination of their choice.

14.2 Booking and Charges

Guests who opt for a Post Tour Holiday must inform their Travel Advisor at the time of booking. The Travel Advisor will guide the guest regarding necessary changes to various services, such as airline return ticket date/sector changes, visa extensions, and insurance validity. Guests can choose from pre-designed Post Tour Holiday packages or opt for a Customized Holiday. The additional charges for the Post Tour Holiday must be paid by the guest immediately.

14.3 Subject to Availability

Post Tour Holiday requests are subject to availability. If the requested package is not available, the guest will need to choose from alternate options.

14.4 Return Flight Re-confirmation

It is the guest's responsibility to re-confirm their return air ticket and flight schedule 24 hours prior to departure.

14.5 Nature of Post Tour Holiday

A Post Tour Holiday is not an escorted group tour; it is a Customized Holiday (FIT), and all inclusions and exclusions will be as per its specific itinerary. 

  

15. Airline

15.1 General Information

Travel Dates' group tours generally include air tickets, though some tour categories may exclude them. For air-inclusive group tours, seats are blocked well in advance by Travel Dates, sometimes up to a year before the tour departure, by paying an advance or deposit to the airline. Actual ticketing for the group occurs closer to the departure date, as per airline ticketing policies. Any increase in airfare, taxes, fuel surcharges, airport development fees, etc., between the tour launch date and departure date will be borne by the guests and must be paid before tour departure.

When you book an air-inclusive tour, a Customized Holiday (FIT) package, or an air ticket with Travel Dates, it is understood that you have accepted the Airline's Terms & Conditions regarding travel, baggage, meals, services, etc., as well as applicable national and international laws governing air transportation (e.g., DGCA, IATA, PATA). In cases of airline service discontinuation, changes in airline routes, flight schedule alterations, or flight delays, any additional expenses incurred to continue the tour will be borne by the guests.

Guests must exercise extreme caution while completing and verifying their booking form for details such as correct name spelling, age, birth date, contact details, passport number, and passport issue date and place. For international tours, the name must always match the passport; for domestic tours, it should match the Aadhar card. Incorrect details may lead to name corrections (if time permits), denial of boarding, deportation, or tour cancellation. Guests will bear the consequences, losses, or additional expenses, and Travel Dates is not responsible or liable for these.

When guests book individual air tickets with Travel Dates, they must ensure they do not hold any other air ticket with the same or a different airline for the same date, as this may result in automatic cancellation of the air ticket. Guests will bear the consequences arising from such a situation.

15.2 Baggage

Travel Dates provides information about the scheduled tour's airline baggage allowance to booked guests before tour departure. Guests should also verify the latest baggage allowance directly with their respective airline for the tour and adhere to the terms and conditions regarding baggage allowance of all airlines they are traveling with. Any excess baggage charges will be borne by the guests.

If you are joining from another Indian city to the main hub where the tour begins and ends, you will use domestic flights to and from your city of residence. The baggage allowance for your domestic airline may differ from that of your scheduled tour airline. Any excess baggage charges for domestic flights will be borne by the guests.

Guests are advised to travel light and carry a mid-size 4-wheel bag, as they will be responsible for carrying their own baggage throughout the tour. Large-size bags should be avoided.

15.3 In-flight Seating

Travel Dates reserves economy class air ticketsfor guests on air-inclusive tours, which do not include specific seating preferences like front row, emergency row, aisle seat, or window seat. If guests wish to book any specific seat, they must inform their respective Travel Advisor and make the necessary payment for the desired facility. This request is subject to airline availability.

On the day of departure, if guests wish to upgrade from economy to premium economy, business, or first class, they may do so, subject to availability, by paying the additional amount directly to the airline.

15.4 Airline Credit Points

Guests who wish to utilize their air miles, frequent flyer points, or credit points for their tour are advised to book the tour as a Joining and Leaving (J/L) or Ex-destination guest and reserve their individual tickets to avail of this facility. Guests will need to communicate directly with the airline(s) regarding their frequent flyer miles. Travel Dates will assist guests if needed.

15.5 In-flight Meals

In-flight meal service is at the discretion of the respective airline.

Requests for vegetarian/non-vegetarian meals and/or special meals should be communicated at the time of booking and are subject to availability with the airline.

Travel Dates is not responsible for any unavailability of requested meal types, or the quantity and quality of in-flight meals.

On domestic and short-haul international tours, in-flight meals are typically not included in the air ticket. Guests are advised to carry snacks for their flight journey.

15.6 Airport Services

Various airports offer special services such as lounge facilities, attendants, and Pranaam Guest Services at an additional cost. Guests wishing to avail such facilities may inform their Travel Advisor to pre-book them. Wheelchair facilities for seniors or physically challenged guests are also available at the airport if pre-booked and are usually free of charge. These facilities are subject to availability.

  

16. Baggage and Belongings

16.1 Guest Responsibility

Guests are advised to travel light, avoid carrying valuables on tour, and take utmost care of their baggage and belongings at all times. Guests should not leave their belongings, such as mobile phones, cameras, laptops, jewelry, gadgets, passports, visas, tickets, currency, purses, or bags, unattended. It is advisable to use digital payment systems like forex cards, credit cards, mobile payments, and e-wallets during the tour. Guests are hereby made aware that they are solely responsible for their personal baggage and all kinds of belongings. Travel Dates or its representative(s) are not responsible for any loss, theft, damage, or accident involving such personal belongings during the tour, flight journey, coach travel, hotel stay, or at sightseeing places, for any reason whatsoever.

16.2 Reporting Incidents

In case of any loss, theft, damage, or accident, it is the sole responsibility of the guest to file a complaint with the concerned local authorities (e.g., police, private bodies, airline office) and follow up with them directly.

16.3 Claims with Third Parties

Any claim regarding loss, theft, damage, accident, or negligence with any associate (e.g., airline, hotel, coach company, sightseeing places) should be addressed directly with the respective associate or insurance company (if applicable). Travel Dates is not liable to pay any compensation to the guest for any dispute arising about the adequacy of the settlement amount or rejection of the claim by the associate or the insurance company.

16.4 Restricted Items and Currency

Customs, immigration, and airlines restrict the carriage of certain items or articles during travel. Additionally, there are restrictions on the amount of currency a traveler is permitted to carry. All guests should be aware of these regulations and ensure they abide by them. If guests are found carrying any restricted objects, excess money, or misplace their passports, they may be detained, miss a flight, and/or the tour may need to be curtailed. Travel Dates will not be responsible for any losses or additional expenses arising from such situations.

  

17. Road Travel on Tour

17.1 Vehicle Allocation: For our tours, we utilize a range of air-conditioned, air-cooled, or non-air-conditioned vehicles as specified in the itinerary. The type of transport, including large coaches, mini-coaches, tempo travelers, jeeps, cars, or taxis, depends on the tour type, itinerary, road conditions, and the number of guests.

17.2 Coach Seating: Seat allocation within coaches is prioritized based on the tour booking date, even when multiple tours are merged. Specific seat numbers are assigned by the Tour Manager on the first day of the tour, one day prior to departure. We are unable to provide seat numbers at the time of booking or before tour departure.

17.3 Prime Seating: In coaches, seating begins from seat number 5. Seats 1 and 2 are reserved for the Tour Manager, while seats 3 and 4 are designated as prime seats, available for an additional charge if requested by guests. If prime seats become unavailable after payment, Travel Dates will only refund the additional cost paid for those seats. Prime seating options are not applicable for smaller vehicles.

17.4 Smaller Vehicles: Certain tours utilize smaller vehicles (e.g., Etios, Dzire, Innova, or similar), accommodating 4-6 guests per car. The Tour Manager will rotate among these vehicles within the group. These vehicles are intended solely for road journeys and sightseeing as per the itinerary and are not at the individual disposal of any guest or group.

17.5 Vehicle Upgrades: Guests or groups may request a separate vehicle for their family or upgrade the vehicle type (e.g., to a tempo traveler, mini-coach, or large coach) for an additional cost, subject to availability.

17.6 Specific Terrain Travel: For tours to destinations like Leh Ladakh, Andaman, Sikkim Darjeeling, and North East, small vehicles accommodating 5-6 guests per vehicle are used due to challenging terrain and limited vehicle availability. The vehicle type may vary daily in these regions, and vehicle upgrades are not possible.

17.7 Driver Respect: Our coach captains and vehicle drivers are crucial to the tour's success. Guests are kindly requested to treat them with respect and be mindful of driving regulations, including daily and weekly driving hour limits and their mandatory rest periods.

17.8 Punctuality: Guests are expected to adhere to the daily schedule and promptly participate in all sightseeing activities as per the itinerary. Should a guest fail to report to the coach at the designated time, the coach will proceed to the next scheduled point. The guest will then be responsible for their own travel arrangements and associated expenses to rejoin the group.

  

17.9 In-Vehicle Policy: To ensure the comfort and safety of all participants, a strict "no smoking," "no alcohol," and "no eating" policy is enforced within all vehicles. Guests are requested to comply with these rules.

17.10 Toilet Facilities: For cleanliness and hygiene, "pay & use" toilet facilities are available at most locations. Guests are advised to carry coins or small change for these facilities.

17.11 Mechanical Failures: In the rare event of a vehicle or air conditioner malfunction during a tour, we will endeavor to find a prompt solution. Travel Dates is not responsible for such mechanical failures and will not provide compensation.

17.12 Vehicle Damage: Guests are responsible for the upkeep of the coach. If any interior or exterior part of the coach is accidentally or intentionally damaged by a guest, the guest will be required to immediately pay for the charges or compensation directly to the coach provider.

17.13 Missed Sightseeing: Travel Dates will not issue refunds for missed sightseeing opportunities resulting from unforeseen circumstances such as road demonstrations, landslides, road closures, or traffic jams.

  

18. Cruises and Rail

18.1 Cruise Offerings: Travel Dates offers exclusive cruise tours, and some of our tours incorporate single or multi-night cruises as part of the itinerary. Cruise-inclusive tour prices are based on inside stateroom, port-hole, or ocean view cabins, as specified in the itinerary.

18.2 Cabin Upgrades: Upgrades to balcony cabins or suites are available at an additional cost, subject to availability.

18.3 Optional Cruise Facilities: Shore excursions not included in the tour or optional facilities on the cruise can be availed by guests directly from the cruise provider for an additional charge.

18.4 Cruise Punctuality: Guests are solely responsible for arriving on time for the cruise, as the vessel cannot wait for late arrivals. In the event a guest misses the cruise, they will be responsible for their own travel arrangements and expenses to reach the next "port of call" or the next tour destination.

18.5 Cruise Tipping Policy: Guests on Customized Holiday packages should be aware of and adhere to the cruise line's statutory tipping policies.

18.6 Rail Journeys: Some tours include rail journeys. Generally, air-conditioned chair cars are reserved for day travel and sleeper berths for overnight travel. Any upgrades to a higher rail class are subject to availability and incur an additional cost.

18.7 Train Punctuality: Guests are responsible for being punctual and not missing their train. Any costs or consequences incurred due to a missed train will be borne by the guest.

18.8 Third-Party Terms: Cruise and rail operators are private organizations, and their own terms and conditions will apply in addition to Travel Dates's Terms and Conditions.

  

19. Cancellation and Refund Policy

19.1 General Policy: Tour and package services are often booked well in advance. Cancellations result in forfeiture of funds depending on the timing of the cancellation with our suppliers. Therefore, any cancellation of a booked tour or service will incur cancellation charges as outlined below. Please note that third-party products or services, such as airlines, cruises, railways, transport, hotels, restaurants, caterers, and sightseeing companies, will have their own terms, conditions, and cancellation policies that apply in addition to Travel Dates's policies.

19.2 Applicability: This Cancellation Policy applies to all guests of Travel Dates who have booked Group Tours, Customized Holidays, MICE Tours, Inbound Holidays, or any independent service from Travel Dates.

19.3 Cancellation Request: All cancellation requests must be submitted in writing via email to tickets@traveldatess.comfrom the guest's registered email ID, clearly stating the reason for cancellation.

19.4 Reinstatement of Booking: Once a booking is canceled, it cannot be reinstated. Any reversal or re-booking will be considered a new booking and may incur additional charges.

19.5 Guest Agreement: All guests expressly agree to abide by the stated policy and terms.

19.6 Specific Cancellation Scenarios:

· a. Guest Initiated Cancellation (Personal Reasons): If a guest cancels a tour or package due to personal reasons (e.g., non-sanction of leave, exam postponement, illness, family emergency), the cancellation date will be determined by the date the cancellation request email is sent (unless the decision is withheld or changed), and corresponding cancellation charges will apply.

· b. Force Majeure/Uncontrollable Factors: Travel Dates reserves the right to postpone or reschedule any tour due to force majeure events (e.g., natural calamities, epidemics, pandemics, terrorist activities, political unrest, curfews, local riots, government orders) or uncontrollable factors (e.g., airline operational changes, disruptions due to political, sports, local, or VIP events at the destination) to ensure guest safety. In such situations, no full or partial refund will be applicable. Guests will be required to choose the next available future date for the same tour. Any price difference for the rescheduled tour must be paid by the guest before departure. Travel Dates will request cooperation from associates (airlines, hoteliers, transporters, etc.) for postponement. If these associates cannot accommodate the request, actual cancellation charges may apply. If a guest wishes to change the destination, the decision will depend on the cooperation of associates and will be communicated as soon as possible. If the new tour's price is higher, the difference must be paid by the guest. If the new tour's price is lower, the remaining amount will be held as a non-refundable credit shell with Travel Dates.

· c. Non-Acceptance of Itinerary/Service Change: Travel Dates reserves the right to modify the itinerary or services for improvement or unforeseen circumstances. Guests cannot withdraw from the tour on this basis. If additional sightseeing or services incur extra charges, guests must pay them. If a guest is unwilling to accept such changes, they must cancel the tour, and standard cancellation charges will apply.

· d. Deemed Cancellation - Visa Rejection/Delay: Visa rejection or delay will result in a deemed cancellation, and the booking will be canceled without further intimation from the guest. The visa rejection date will be considered the cancellation date, and applicable cancellation charges will apply. Guests may re-apply for a visa by paying additional charges; however, visa approval is at the discretion of the respective consulates, and Travel Dates is not responsible for the outcome. If a visa is not granted even after a second application, cancellation charges will be based on the second rejection date. If no visa intimation is received before tour departure, it is considered a deemed cancellation, and charges will apply. In group bookings, if one individual's visa is rejected or delayed and the rest of the group cancels, cancellation charges will apply to the entire group. Guests are responsible for verifying the accuracy of visa details. Travel Dates is not responsible for any refunds, losses, or consequences if immigration denies entry or exit due to incorrect visa information. For bookings where air tickets or visas are processed more than 91 days in advance, actual charges for air and visa fees will apply in addition to regular tour cancellation charges.

· e. Deemed Cancellation - Non-Payment: Guests are required to pay the full tour price at the time of booking, or 60/30 days prior to the tour departure, as applicable. Failure to make payment within the specified timeframe grants Travel Dates the right to cancel the booking without written notification and forfeit any amount paid. Travel Dates's cancellation notice date will be considered the deemed cancellation date, and charges will apply as per the Cancellation Policy.

· f. Deemed Cancellation - "No Show" on Day 1: If a guest fails to join the tour on the first day ("No Show"), it will be considered a deemed cancellation, and no refund will be applicable. All services will be canceled, and 100% cancellation charges will apply, unless the guest notifies Travel Dates of their intent to join the same tour later at their own expense.

· g. Deemed Cancellation - Discontinuation from Ongoing Tour: If a guest discontinues or terminates a tour for any personal reason, it is considered a deemed cancellation, and no refund will be applicable. The Travel Dates team will assist with booking required services, but all associated expenses must be paid by the guest immediately in advance.

· h. Single (Solo) Guest Room Sharing Cancellation: Solo guests are encouraged to book specialty tours (e.g., Women's Special, Seniors Special, Adventure Special) where Travel Dates guarantees a room partner, allowing guests to save on single occupancy charges. If a solo guest on a regular tour books a single occupancy room and later gets a room partner for the entire tour, the single occupancy charge will be refunded within 10 working days of tour completion. In case one of the room-sharing partners cancels, no refund of the single occupancy charge is applicable.

· j. Included Expenses: The aforementioned cancellation charges cover various direct and indirect expenses incurred in preparing and operating the tour.

· k. Charge Breakdown: Travel Dates is not obligated to provide a detailed breakdown or bifurcation of the tour price or cancellation charge.

· l. Refund Processing: Any refund due to a guest as per the Cancellation Policy will be processed within 30 working days of receiving final confirmation of the cancellation request.

19.7 Cancellation by Travel Dates: Travel Dates reserves the right to cancel any group tour or package due to operational reasons or insufficient guest participation. In such cases, guests will be notified via their registered email, telephone, or SMS. The amount paid by the guest will be refunded within 30 working days of the tour's cancellation via A/C payee cheque, NEFT, or RTGS. Travel Dates will not be liable for any interest on the refunded amount or for any additional expenses incurred by guests for independently made arrangements. Guests wishing to book another tour can consult with their Travel Advisor, and any excess or short payment for the new tour will be adjusted accordingly.

19.8 Right of Admission and Termination: Travel Dates reserves the right to refuse any booking or cancel an accepted booking without providing a reason. Travel Dates also reserves the right to terminate a guest's tour if they fail to adhere to group tour decorum, misbehave, or create a nuisance for co-passengers, the Tour Manager, coach captain, local citizens, or officials. In such instances, the guest will be responsible for their return travel arrangements, and no refund will be applicable.

19.9 Tour Transfer: If a guest wishes to transfer their original tour to a new one for any reason, it will be considered a cancellation of the original tour and a new booking for the desired tour. Cancellation charges will apply to the net tour price of the original tour. The new tour will be subject to prevailing tour prices and discounts. All transfer requests must be submitted in writing to the Travel Advisor and are subject to availability.

19.10 Merging of Tours: Travel Dates reserves the right to merge two or more tours due to insufficient participation in a single tour or for operational reasons. Seat allocation in the coach for merged tours will be based on the booking date priority.

19.11 Refund Determination: Travel Dates retains the right to determine the refund amount payable to a guest for cancellations, transfers, or amendments. Refunds are calculated based on factors such as the cancellation date, reduction in tour capacity, contractual agreements, and cancellation policies of associates (airlines, hoteliers, transporters, etc.). Travel Dates's decision regarding the refund amount, as per the Cancellation Policy, is final and will be paid directly to the guest. As per Government of India regulations, refunds from Travel Dates for both Indian and international tours will be paid only in Indian Rupees via A/C payee cheque, NEFT, or RTGS, regardless of the original payment currency. Refunds are typically processed in the name of the family head on the booking form, or in the case of ad-hoc/corporate groups, in the name of the institution/company that made the payment. Travel Dates is not liable to pay any interest on the tour amount. Convenience charges for payments made by Credit Card, Debit Card, or Online Transfer are non-refundable. Tax Collected at Source (TCS) for international tours is non-refundable as it is deposited with the income tax department and linked to the guest's PAN; it can be claimed by the guest when filing their annual income tax returns. In force majeure or uncontrollable situations, Travel Dates reserves the right to levy non-refundable 'tour transfer charges' or 'service charges' for standalone services. For FIT/Customized packages, the Holiday Design Fee charged at the time of inquiry is non-refundable if guests do not book the holiday with Travel Dates. If the tour price includes a visa fee and the consulate/VFS/embassy requires direct payment by the guest, a visa fee reduction will be applied at the time of booking or refunded within 7 working days of receiving the visa payment receipt from the guest. If a tour price includes a visa fee and the guest holds a valid visa, they must submit a copy at the time of booking to avail the visa fee reduction. If the tour is rescheduled due to unforeseen circumstances, the guest will be responsible for obtaining a new visa according to the new schedule and bearing the associated costs.

  

20. Accommodation on Tour

20.1 General Accommodation: Accommodation for tours varies based on the tour/package category and may include resorts, hotels, houseboats, tents, camps, dormitories, hostels, cruises, or trains. The location of accommodation typically aligns with the tour program. Suggested hotel names or accommodation types in the tour program are subject to availability. Similar tours may utilize different hotels or accommodation types depending on capacity and availability at the destination. Hotel membership rewards or points cannot be earned or redeemed with hotels booked by Travel Dates.

20.2 Room Types: Generally, rooms are twin/double or single-bedded. An extra bed, if requested, is typically provided as a mattress on the floor. Guests may upgrade to suites, family rooms, or specific view rooms for an additional cost, subject to availability. Guests desiring an additional room during the tour can do so, subject to availability and an additional charge. Single rooms are generally smaller and may be located on different floors or corners of the hotel. Room assignments are at the discretion of the hotel, associate, or supplier providing the service and are not controlled by Travel Dates.

  

20.3 Check-In and Check-Out: Standard hotel practice worldwide dictates a 3 PM check-in and 10 AM check-out time. Our itineraries are planned accordingly. Guests should be aware that early morning arrivals at a destination do not guarantee immediate hotel check-in; in such cases, we may proceed with sightseeing activities before check-in. Guests wishing to check-in early or check-out late can request this, subject to availability, for an additional charge. Some accommodations may require a credit card or security deposit at check-in, which is refundable upon check-out, based on services utilized.

20.4 Room Sharing: Single (solo) guests sharing a room with another guest must adhere to Travel Dates's room sharing policy, which is provided via email upon booking. Any issues, such as misunderstandings between sharing partners, or damage/loss of personal items or hotel property, are the sole responsibility of the sharing partners and must be resolved between them. Travel Dates is not responsible for such matters. Any room-sharing partner exhibiting harmful, unhygienic, or intolerable behavior will be required to take a separate room immediately during the tour, incurring additional single occupancy charges.

20.5 Children Sharing with Parents: For comfort and convenience, we recommend that families of three opt for a double room with an extra mattress, and families of four consider two rooms. Most hotels, both international and Indian, do not permit four people in one room for safety reasons.

20.6 Property Damage: Guests are responsible for any damages caused to hotel rooms or accommodation types during their stay and must pay for them immediately or before check-out. If guests discover any pre-existing damage in a room, they must immediately report it to the hotel staff and/or Travel Dates Tour Manager. Travel Dates is not responsible for such losses or liable for any associated charges.

20.7 Accommodation Facilities: Accommodation facilities such as parking, restaurants, coffee shops, bars, gymnasiums, spas, salons, swimming pools, sports and entertainment activities, child care/play centers, meeting rooms, business centers, travel desks, doctor on call, lifts/elevators, porter services, laundry, internet, Wi-Fi, telephones, mini-bars, alcoholic beverages, paid television channels, air conditioners, in-room safes & amenities, and room service may be available depending on the tour type or destination, and will vary by property. These facilities may or may not be complimentary, and guests must verify charges before use. Any charges incurred for using such facilities must be paid directly to the hotel by the guest. Travel Dates shall not be liable for any disruption of services, facilities, or amenities offered at the hotel or accommodation, nor for any service deficiencies, including unprofessional behavior of hotel staff, as these are beyond Travel Dates's direct control. To promote sustainability, many countries, governments, local communities, private establishments, and independent bodies have enforced restricted use of water, electricity, and air-conditioning, which responsible tourists are expected to follow.

20.8 Accommodation in Natural Settings: In accommodations located in natural surroundings (e.g., tents, camps, safari lodges, beach resorts), the presence of insects (ants, cockroaches), birds, monkeys, small animals, and occasional rodents around the room or hotel grounds is common. This should not be interpreted as a lack of cleanliness, but rather as a characteristic of these destinations. 

  

21. Meals

21.1 Meal Inclusions: Meals provided on tour are as specified in the itinerary (B - Breakfast, L - Lunch, D - Dinner). These are pre-set menus, primarily Indian meals, with occasional local or international cuisine depending on the destination and tour. Indian meal menus typically include dal, rice, roti, two vegetables, one non-vegetarian item, salad & accompaniments, and dessert.

21.2 Packed Meals: Depending on the tour program, packed meals may be served at certain locations.

21.3 Special Dietary Needs: Special meal or diet requests can be accommodated to a limited extent in group tours if informed at the time of booking. Guests with specific dietary needs should carry their own dry snacks, as special requests may not be fulfillable at all locations.

21.4 Jain Meals: If informed at the time of booking, Jain meals (without onion and garlic) will be served for lunch and dinner as per the tour itinerary, though not necessarily before sunset. This may be a buffet or table service.

21.5 Baby Meals: Baby meals generally consist of milk, plain dal, and rice. We recommend that guests with very young children carry their preferred baby food if needed.

21.6 Missed Meals: Any meal missed due to a guest's personal reasons will not be substituted or compensated.

21.7 Restaurant Quality: While we strive to select high-quality restaurants for meals, we do not have direct control over their operations regarding food, hygiene, or sanitation facilities. Travel Dates is not responsible for any deficiencies in quality or service from these establishments, and no complaints or claims in this regard will be entertained.

  

22. Tour Managers

22.1 Tour Manager Role: Travel Dates's Tour Managers are highly regarded and accompany guests on group tours from the first to the last day, as detailed in the itinerary. To ensure an enjoyable tour, guests are advised to follow the Tour Manager's instructions regarding the tour schedule, safety precautions, clothing, essential items, meal information, sightseeing details, local etiquette, and general do's and don'ts. The Tour Manager is not responsible for any consequences arising from ignored or overruled instructions by guests.

22.2 Respect and Feedback: Guests are kindly requested to treat Tour Managers with respect, as they are dedicated to ensuring a successful tour. Any on-tour service issues or complaints should be immediately brought to the Tour Manager's attention for prompt resolution.

22.3 Personal Responsibility: While Tour Managers are available to assist guests, they are not responsible for any theft, loss, or damage to personal belongings, nor for any injuries or accidents sustained by guests. Due to their responsibility for managing the entire group and adhering to the itinerary, Tour Managers cannot personally accompany guests or remain with them in case of an emergency. However, they will provide guidance on further procedures or how to lodge complaints with local authorities. Any expenses incurred will be borne by the guests.

22.4 Lost and Found: If a guest's personal belonging is lost and found after departing from a destination, the guest will be responsible for arranging courier services and bearing the associated expenses to retrieve it. Travel Dates and its Tour Managers are not responsible for retrieving lost and found items from any destination.

22.5 WhatsApp Group Communication: For efficient communication and clarity, Travel Dates's Tour Managers will create a WhatsApp group for guests on the second day of the tour (this may be occasionally unavailable due to internet limitations). This group is exclusively for sharing tour-related instructions and the next day's itinerary. Guests who object to being part of this group should inform the Tour Manager immediately.

22.6 Language of Communication: On group tours, the primary languages of communication are Hindi and English. Tour Managers will communicate in Hindi and/or English. On international tours, local guides, hosts, ship crew, and hotel representatives typically speak English. Guests are expected to be conversant in these two languages. If a guest is unfamiliar with these languages, Tour Managers will make every effort to assist and ensure their comfort and understanding of the tour program.

22.7 Tour Manager Limitations: Travel Dates's Tour Managers are not responsible for, nor can they assist in altering or amending, the following:

· Itinerary and its inclusions under normal circumstances, as they are predetermined by Travel Dates.

· Flight seat allotment, as this is at the discretion of the airline.

· Coach seat allotment, as it is assigned based on booking date priority.

· Room allotment, as this is at the discretion of the hotel.

· Any missed sightseeing due to guests not adhering to timings.

22.8 Manager's Conduct and Transactions: Tour Managers are under contractual obligation to Travel Dates and are expected to provide the highest quality of services. However, Travel Dates is only liable for acts performed by Tour Managers within the scope of Travel Dates tours and is not responsible for any personal actions. Guests are advised to refrain from engaging in any monetary or other personal transactions with Tour Managers.

  

23. Shopping

23.1 Responsible Shopping: Shopping is an integral part of any tour experience. Guests are encouraged to shop responsibly and to verify the price and quality of items they intend to purchase. Travel Dates explicitly states that it neither recommends nor promotes any specific shop or vendor and is not responsible for any items purchased during the tour. Some sightseeing locations may have their own souvenir shops, flagship stores, or galleries where shopping is optional. When shopping, guests should be mindful of quality, quantity, price, and be aware of VAT refunds, baggage allowances, courier charges, shipping, freight, and customs duties, where applicable.

  

24. Gift Vouchers

24.1 Purchase and Issuance

Travel Dates offers Gift Vouchers for purchase by customers, allowing them to be gifted for various occasions. Additionally, Travel Dates may issue Gift Vouchers as prizes or benefits.

24.2 Voucher Conditions

Gift Vouchers are subject to the following terms:

· Redemption: Vouchers are redeemable solely against Travel Dates' group tours (subject to availability) or holiday packages.

· Validity: Each voucher has a specified validity period and must be redeemed within this timeframe.

· Usage Limitations: Vouchers cannot be split, nor can multiple vouchers be combined for a single tour booking.

· Non-Transferable & Non-Refundable: Vouchers are non-transferable, non-refundable, and cannot be encashed.

· Redemption Process: To redeem, guests must provide the digital code received at the time of voucher issuance.

· Exclusions: Gift Vouchers are not applicable for one-day tours, picnics, stand-alone services, or tours priced below INR 20,000.

· Applicable Terms: All general Travel Dates Terms and Conditions apply to Gift Voucher redemptions.

  

25. Guest Participation in Tours

25.1 Eligibility

Travel Dates welcomes Indian citizens, Non-Resident Indians (NRIs), and foreign nationals to join our tours within India and internationally. Guests should be in good mental and physical health and are advised to consult their physician before embarking on a tour. Guests with disabilities should verify destination facilities before booking and must be accompanied by a family member.

25.2 Safety and Well-being

The safety and well-being of all guests on group tours are paramount. Any guest posing a threat to fellow travelers or deemed unfit to participate in sightseeing or continue the tour will be restricted from activities or compelled to discontinue the tour. In such instances, Travel Dates will assist with onward arrangements; however, all associated expenses will be borne by the guest, and no refund of the tour price will be provided.

25.3 Medical Assistance

Should a guest require medical assistance during a tour, arrangements will be made through local doctors or hospitals. All costs related to such medical aid are the guest's responsibility. We strongly recommend all guests acquire medical insurance covering hospitalization and other medical expenses.

25.4 Physical Demands

Guests should be aware that some tours may involve challenging terrain, extensive walking (including cobblestone streets, uneven pavements, steps, and hill climbs), and locations with limited accessibility.

25.5 Adventure Activities

Guests must ensure they are physically capable of participating in any included or optional outdoor/adventure activities. Travel Dates bears no responsibility for any injury, accident, or mishap resulting from such participation.

25.6 Special Services

Guests requiring special assistance must be accompanied by a family member or relative on the tour. Services such as a caretaker, wheelchair, or airport assistance can be arranged at an additional cost, subject to availability.

  

26. Guest Responsibilities

26.1 Booking Information Accuracy

The accuracy of guest details provided on the booking form is crucial, as all subsequent tour arrangements depend on it. Guests are urged to verify and reconfirm all details on their booking form to prevent substantial losses. For tours booked through Travel Dates' sales office or a sales partner, guests must authenticate the booking form and ensure immediate receipt of a confirmation call and an auto-generated SMS from Travel Dates' corporate office.

26.2 Information Authenticity

When submitting any information to Travel Dates during inquiry, registration, booking, or visa/insurance processing, guests must ensure all details (e.g., tour date, name, age, birthdate, address, Aadhar/PAN/passport details, and required financial information for visa consulates) are accurate, truthful, current, and complete.

· Travel Dates will rely on the information provided by the guest to proceed with all tour formalities. Should any incorrect detail be found on the booking form, the guest must inform their Travel Advisor and facilitate correction within 24 hours of booking.

· Incorrect information may lead to tour amendments or cancellations. Any associated costs for amendments or losses due to cancellation will be borne by the guest, and Travel Dates will not be held liable. Guests must promptly update any changes to their registered contact details through their Travel Advisor to avoid missing important information.

26.3 Document Submission and Collection

For any tour, guests are responsible for submitting valid documents for booking processing and collecting necessary documents from Travel Dates prior to the tour. Guests must adhere to shared timelines to avoid issues with booking or joining the tour. Timelines are communicated periodically via the guest's registered contact details.

26.4 Essential Documents on Tour

While on tour, guests must carry original documents such as Aadhar card, PAN card, passport with valid visas, air tickets, insurance copies, NOC (if required for minors/children), vaccination certificates, health reports (if mandatory), and any other personal/legal documents required for immigration. Guests are also advised to keep photocopies of important documents both with them and at home for emergencies.

26.5 Tour Selection and Customization

Guests should select a group tour or customized holiday that aligns with their preferences to maximize their vacation experience. Group tours have pre-set itineraries, accommodation, and services. For customized holidays, guests must ensure they have selected services that meet their expectations and confirm the booking. Customized Holidays do not include on-site Tour Manager services; however, all arrangements will be managed by local associates, and Travel Dates will provide virtual assistance. Guests are required to stay in touch with Travel Dates' guest relations representative. Tour Manager services for Customized Holidays (FIT packages) can be arranged at an additional cost, subject to availability.

26.6 Conduct on Group Tours

Guests on group tours are expected to conduct themselves appropriately for group travel. Any abusive, aggressive, or harmful behavior towards co-travelers, Travel Advisors, Tour Managers, or associate representatives will lead to booking cancellation or removal from the tour. Travel Dates reserves the right to terminate such guests' participation without liability for refunds, compensation, or consequences.

26.7 Prohibited Items

In accordance with immigration, customs, government, and community laws, guests are strictly prohibited from possessing or carrying illegal or restricted items such as narcotic drugs, weapons, ammunition, or explosives. Discovery of such items will result in immediate tour discontinuation and potential legal action under applicable laws.

26.8 Punctuality and Instructions

Guests must follow the Tour Manager's instructions and maintain punctuality. Any missed sightseeing or service due to guest delays is solely the guest's responsibility, and any resulting expenses or losses will be borne by the guest.

26.9 Property Damage

Guests are responsible for the care of both private and public property while on tour. Any expense or penalty incurred due to damage caused by guests (knowingly or unknowingly) to hotel property, aircraft, trains, cruises, coaches, or sightseeing attractions must be borne and settled immediately by the guests.

26.10 Reporting Issues

Any inconvenience experienced by guests during a tour should be immediately brought to the attention of the Tour Manager to facilitate a prompt solution from relevant officials where possible.

26.11 Acknowledgment of Risks

Guests acknowledge that participation in tours operated by Travel Dates involves certain risks and dangers beyond our control. These include, but are not limited to: hazards of travel in undeveloped areas (narrow roads, ghats, low oxygen levels); travel by various modes (boat, train, automobile, aircraft); forces of nature; political unrest; acts of unlawfulness or terrorism; animal interaction; hazardous local customs; varying sanitation and safety standards; risks associated with water, air, fire, food, plants, insects, and animal regulations; accidents or illnesses in areas lacking rapid evacuation or medical facilities; and acts of governments or others against governments. This is not an exhaustive list. Guests voluntarily participate in these activities with full knowledge of significant dangers and agree to accept all associated risks.

26.12 Compliance with Laws

Should guests be unwilling or unable to visit a country or part thereof due to governmental laws, conditions, or requirements, they are solely responsible for any missed visits, losses, damages, or incurred costs. Travel Dates will not be liable for any refunds, compensation, or consequences.

26.13 Release of Liability

As lawful consideration for the agreement with Travel Dates to participate in a tour, guests agree not to make any claims against Travel Dates, its associated entities, or personnel, nor sue for bodily injury, emotional trauma, death, property loss, or damage, regardless of cause.

26.14 Insurance Claims

We recommend all guests secure insurance before joining a tour. In the event of an accident or incident leading to an insurance claim, guests must directly communicate with the insurance provider and furnish all necessary documents for claim settlement. The approval or rejection of any claim rests solely with the insurance company, and Travel Dates holds no responsibility. Any disputes regarding claim adequacy or rejection must be directly handled by the guest with the insurance company.

26.15 Baggage Policy

Airlines, cruises, and trains are enforcing stricter baggage policies regarding size and weight. Guests are advised to travel light with easily manageable bags. Guests are responsible for directly paying any porter charges or tips if such services are utilized at train stations, airports, cruise terminals, immigration points, hotels, or other locations.

26.16 Tipping

Tipping is customary worldwide for services rendered by porters, coach drivers, guides, etc., unless explicitly stated as included in the tour itinerary.

26.17 Unauthorized Service Utilization

Friends, relatives, or colleagues visiting guests on tour are not permitted to utilize any services unless prior permission has been obtained and payment made in advance. Such admission or permission is subject to availability.

26.18 Binding Agreement

This agreement, though entered into on your behalf, also binds your heirs, assigns, and legal representatives.

26.19 Personal Expenses

Travel Dates generally includes all services and maximum sightseeing as per the tour itinerary. However, guests should carry sufficient funds for personal expenses, shopping, optional sightseeing, local delicacies, beverages, additional hotel/resort facilities, and any emergencies arising from medical reasons or unforeseen/force majeure situations. 

  

27. Liabilities and Responsibilities of Travel Dates

27.1 Role as Facilitator

Travel Dates acts as a facilitator, coordinating with various independent service providers (including, but not limited to, airlines, cruises, railways, transporters, sightseeing companies, hoteliers, restaurateurs, caterers, and snack suppliers) for tour-related services. While utmost precaution is taken to ensure smooth tour operations, Travel Dates has no control over the operations and functioning of these independent providers. Therefore, Travel Dates is not responsible or liable for compensation for any operational inefficiency, misrepresentations, acts, omissions, errors, warranties, breaches, or negligence on the part of any service provider.

27.2 Medical Care Disclaimer

Travel Dates will not be liable for the provision or adequacy of medical care rendered in cases of medical emergencies or accidents. We are not responsible for risks and dangers that may arise beyond our control.

27.3 Courtesy Gestures

Any courtesy gesture extended by Travel Dates to guests during a force majeure or unforeseen situation to minimize impact, loss, or damage does not constitute an admission of liability or a waiver.

27.4 Correction of Errors

Human errors and omissions are expected. Travel Dates reserves the right to correct any mistake in tour pricing and re-invoice the guest, even if the booking is confirmed. If a guest disagrees and wishes to withdraw the booking, they must convey this immediately within 48 hoursof notification of such error. In such cases, the booking will be cancelled, and the advance payment refunded within 10 working days.

27.5 Advertised Personnel

Should the presence of a celebrity, dignitary, or Travel Dates founder be advertised as part of a tour itinerary, Travel Dates will not be held responsible if, due to unavoidable circumstances, such assigned personnel are unable to join the tour.

27.6 Tour Withdrawal and Personal Losses

Cancellation Policy will apply for any tour withdrawal, regardless of the reason. Travel Dates is not liable for any losses incurred by guests in their personal capacity, including but not limited to loss of job, business, occupation, contract, interruption, or loss of business opportunity.

The Travel Dates website is provided for guests to access information regarding tours, packages, and other relevant details. The content on our website is in English. While every effort is made to ensure information accuracy, Travel Dates cannot be held responsible for typographical errors or errors arising from unforeseen circumstances.

Although reasonable efforts are made to update website information, Travel Dates makes no representations, warranties, or guarantees, express or implied, regarding the accuracy, completeness, or up-to-dateness of the content. Website content is valid only at the time of download and may change upon subsequent visits.

Maps, photographs, and descriptions of locations/attractions/hotels used on the website or any promotional medium are indicative and not to scale. 31.1 Personal Information Handling

Personal information shared by guests, necessary for booking processing, is treated as confidential. Travel Dates will use guest personal information, which may include name, age, birth date, address, phone number, email ID, Aadhar number, PAN number, passport number, and additional details like religion, health and mobility status, medical history, and dietary preferences. To facilitate travel arrangements, this personal information may be shared with consulates, embassies, visa facilitators, tourism organizations, customs/immigration authorities, airlines, cruises, railways, hoteliers, destination management partners, marketing and communication service providers (for SMS, email, WhatsApp), associates and partners, Tour Managers, and to a limited extent, co-travelers.

31.2 Disclosure Requirements

In addition to the above, guest personal information is subject to disclosure as required by law, court order, or inquiry by any government or statutory authority.

31.3 Communication Consent

Travel Dates sends transactional and promotional SMS/email/WhatsApp/phone calls to provide updates on tour status, new launches, promotions, festive offers, and greetings. By booking a tour/package, you consent to your personal data being used and shared with relevant third parties as outlined above.

31.4 Promotional Usage

Travel Dates reserves the right to use guest testimonials, emails, on-tour photos, video clips, and social media posts tagged to Travel Dates for the promotion of tours, packages, destinations, and informational videos across any media without obtaining further consent or payment for such photographs and/or videos.

31.5 Client Referrals

Travel Dates reserves the right to refer a guest, upon request, to prospective guests for the promotion of Travel Dates' business.

31.6 Confidentiality Statement

Information concerning Travel Dates or any of its associated entities, their employees, partners, associates, agents, guests/customers, or others whose data is collected, stored, or processed, is the property of Travel Dates and is confidential, except for necessary disclosures required by law and for tour proceedings.

  

32. General Terms

32.1 Amendments to Terms and Conditions

Travel Dates may revise these Terms and Conditions periodically without prior notice. Such changes will be updated by publishing the new version on our website. Guests are expected to check these terms each time they visit our website to stay informed of any changes or updates. By continuing to use our website after any revision, you are deemed to have accepted the updates. The latest updated Terms and Conditions will supersede all previously sent/published versions.

32.2 Authority to Vary Terms

No person other than Travel Dates, in writing, has the authority to vary, add, amplify, or waive any stipulation or representation of these Terms and Conditions. Employees and Partners of Travel Dates have no authority to vary, add, amplify, or waive any stipulation, representation, term, or condition set forth in Travel Dates' Terms and Conditions. Any assurance given by any employee or agent shall have no effect or consequence.

32.3 Enforceability

Should any of these Terms and Conditions be deemed invalid, that invalid provision shall be construed to be consistent with applicable law and in a manner that remains consistent with the original intent of Travel Dates. Provisions not otherwise held invalid shall remain in force.

32.4 Consumer Rights Preservation

If you are acting as a guest (i.e., an individual for private purposes not associated with a business or profession), nothing in these Terms and Conditions shall affect your legal rights as a consumer to the extent they may not be excluded or limited by law, and our Terms and Conditions shall be read subject to this.

32.5 Jurisdiction

This Agreement is subject to interpretation under the laws of India. All disputes pertaining to the tour/package/service and any unresolved disputes/claims arising therefrom shall be subject to the Court of Jurisdiction at Bengaluru (India) only.

32.6 Complaint Procedure & Consumer Protection

Should any guest have a query, concern, or problem during their booking process or holiday, they must immediately inform their Travel Dates Travel Advisor or Tour Manager present on tour. For Customized Holidays, they should contact their virtual guest relations representative. We will endeavor to resolve the query or find a solution as soon as possible. If the matter is not resolved locally, guests should call the Travel Dates guest relations emergency number +91-9008101580 or write to tickets@traveldatess.com, quoting their booking reference number and all relevant information. Failure to follow this procedure may delay or deny us the opportunity to investigate and rectify the problem, which may affect how the complaint is handled and their rights under this contract. Any unresolved issue must be brought to our notice within 7 days after the completion of the tour/service. Travel Dates will prioritize resolution; however, the timeline will depend on the factors involved. Claims made after 7 days of tour completion will not be considered by Travel Dates.

32.7 Applicable Law and Dispute Resolution

Travel Dates is committed to participating in a consumer-friendly dispute resolution process. Both the guest and Travel Dates retain the right to seek relief in small claims court [Bengaluru] as an alternative to arbitration. At least 90 days prior to filing a complaint against each other, Travel Dates and the guest agree to notify the other party of the dispute in writing and attempt in good faith to negotiate an informal resolution. Guests must send all communication related to such disputes or any other notice or legal complaints to the Travel Dates corporate office, situated at Bengaluru, India. Travel Dates will reply to the registered email address of the guest provided at the time of booking. A notice must include: the party’s name and preferred contact information, a brief description of the dispute, and the relief sought. If the parties are unable to resolve the dispute within the 60-day period, only then may either party commence legal proceedings by filing a written Complaint at the Consumer Redressal Commission or the Court of Law. Any such notices pertaining to legal disputes must be sent to the Travel Dates Corporate office located in Bengaluru, India.

32.8 Arbitration

Any dispute arising from or in connection with these Conditions, and/or the subject matter or any agreement between guests and Travel Dates, including any question regarding its existence, validity, or termination, shall be referred to an Arbitral Tribunal consisting of a sole Arbitrator appointed by mutual consent of both parties. The Arbitrator shall not be related, directly or indirectly, as an employee, agent, dealer, or representative of either party, or otherwise interested in the other party or its business. Arbitration proceedings shall be conducted in English, and the venue for such Arbitration shall be Bengaluru. Expenses incurred in such Arbitration proceedings shall be borne equally by both parties.

32.9 Indemnification

Guests shall fully indemnify and hold Travel Dates harmless if any suit, action, application, revision, writ petition, execution proceedings, claim, demand, or any other legal proceedings are initiated against Travel Dates due to any action(s) of the guest. Guests also agree to indemnify Travel Dates against all third-party claims, actions, damages, and remedies that may be brought against us in respect of their participation in the operation of the tour.

32.10 Disclaimer of Warranties

You expressly agree that your use of, or inability to use, the service is at your sole risk. All products and services delivered to you through the service are (except as expressly stated by us) provided 'as is' and 'as available' for your use without any representation, warranties, or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, fitness for a particular purpose, durability, title, and non-infringement. Furthermore, it is not warranted that your use of our service will be uninterrupted, timely, secure, or error-free, or that the results obtained from the use of the service will be accurate or reliable.

32.11 Attorney/Client Fees

If guests are unsuccessful in any legal action instituted against us, they must indemnify us for the full amount of any claim, including but not limited to legal costs, attorney/client fees, etc.

  

33. Travel Voucher Specific Conditions

Please note the following additional conditions for vouchers:

· A trip must be booked (deposit paid) with the voucher before its expiration date.

· Vouchers are valid only for customized tours. They cannot be used for group departures, pre-designed packages, or other standard travel options.

· All vouchers are valid for 6 months from the date of issue unless otherwise specified. Unused vouchers after this period will be forfeited without any refund or exchange.

· Vouchers may be used for your own tours or by a referral, have no cash value, and can only be applied toward Travel Dates tours.

· Vouchers can be used as full or partial payment for a tour, but trips booked with vouchers are not eligible for cash refunds.

· Each voucher may be used for a single transaction only; any remaining balance cannot be exchanged for cash or another voucher and will be forfeited automatically.

· The voucher number must be submitted/entered at the time of booking, and an email should be sent to tickets@traveldatess.comto confirm the voucher application. The booking balance will be adjusted accordingly.

· Vouchers cannot be combined with any other vouchers, discounts, or promotions.

· Vouchers are only valid for new bookings and may not be applied to existing bookings.

· Travel Dates reserves the right to amend these terms and conditions without prior notice.

  

Terms and Conditions for All Tours

These terms and conditions, along with the code of conduct, govern participation in all tours organized by Travel Dates.

Participant Expectations and Responsibilities

1. Professional Conduct: Participants must maintain professional and respectful communication and conduct at all times, whether in person, over the phone, or through online chat. Travel Dates reserves the right to terminate tour participation for any individual engaging in inappropriate or disruptive behavior, without a refund.

2. Timely Compliance: All required documents, payments, and other requests from Travel Dates must be submitted by the specified deadlines. Failure to comply may lead to the termination of your tour participation and forfeiture of any payments made.

3. Behavioral Standards: Positive and respectful behavior is expected from all participants. Travel Dates may discontinue services for any individual whose behavior is deemed unacceptable, to ensure a positive experience for everyone.

4. Refund Policy: Refunds are granted solely at the discretion of Travel Dates. No refunds will be provided for terminations due to non-compliance with these terms, disruptive behavior, or failure to meet deadlines. By joining a Travel Dates tour, participants agree to these terms, acknowledging that decisions made by Travel Dates are final.

  

Cancellation Policy

· Participant Cancellation: A 100% cancellation fee will be charged on the total cost if a participant cancels their booking. The canceling participant will be responsible for any resulting losses or penalties, including any impact on other group members.

· Tour Cancellation by Instructor/Institution: If a tour is canceled by a participant, wellness instructor, or collaborating institution, the party initiating the cancellation will be liable for any losses incurred by other participants who have made partial payments and intended to join the tour. Any full or partial payments made by participants, along with additional expenses (e.g., flights, accommodations, pre-booked services), must be refunded immediately or within three days by the participant, wellness instructor, or institution responsible for the tour's cancellation.

To ensure a positive, respectful, and enriching experience for all, participants are expected to adhere to the following guidelines:

1. Respect and Inclusivity: Respect the privacy, personal space, and beliefs of others. Kindness and inclusivity are paramount.

2. Punctuality: Be on time for all scheduled activities and meetings to ensure smooth operations and respect everyone's time.

3. Health and Safety: Strictly follow all health and safety protocols, especially those related to wellness activities.

4. Communication: Maintain open, honest, and respectful communication. Address any concerns or issues with the tour leader promptly.

5. Mindfulness and Presence: Engage fully in all activities, practicing mindfulness and presence during wellness sessions.

6. Environmental Respect: Minimize waste and adhere to sustainable practices to respect the environment.

7. Substance Use: Comply with policies regarding alcohol and other substances, often advocating for moderation or abstinence during wellness activities.

9. Dress Code: Wear appropriate attire for wellness activities and adhere to local customs.

3. Prioritize Safety: Ensure all activities are safe and suitable for participants. Have a first-aid kit readily available and know the locations of nearby medical facilities.

4. Be Attentive: Pay close attention to individual participant needs and preferences, and be available for personal consultations when required.

5. Encourage Participation: Motivate participants to engage in activities by creating a non-judgmental and comfortable environment.

6. Provide Nutritional Guidance: Offer healthy meal and snack options, and educate participants on the benefits of various foods.

7. Incorporate Mindfulness: Include sessions on mindfulness, meditation, or relaxation techniques, encouraging participants to connect with nature.

8. Offer Variety: Incorporate diverse wellness activities (e.g., yoga, hiking, workshops) to cater to different fitness levels and preferences.

10. Follow Up: Check in with participants after the tour to offer ongoing support and provide resources for maintaining wellness practices.

Don'ts for Instructors:

1. Overload the Schedule: Avoid packing too many activities into the itinerary; allow for adequate downtime and rest periods.

2. Ignore Individual Needs: Do not overlook the specific needs or limitations of participants, and avoid a one-size-fits-all approach.

3. Be Inflexible: Do not adhere rigidly to the schedule if adjustments are necessary. Be adaptable to changes like weather or participant energy levels.

4. Neglect Safety: Do not overlook potential hazards in activities or the environment; always prioritize participant safety.

5. Push Too Hard: Avoid pressuring participants to engage in activities beyond their comfort level, and be mindful of signs of fatigue or distress.

6. Ignore Feedback: Do not dismiss participant feedback or complaints; use feedback constructively to enhance the experience.

7. Be Unprepared: Do not conduct activities without proper equipment or knowledge, and always have contingency plans.

8. Neglect Inclusivity: Avoid creating an environment where any participant feels excluded or marginalized; ensure all activities are accessible.

9. Overpromise: Do not make unrealistic promises about tour outcomes; set clear and achievable goals.

10. Forget to Have Fun: Do not make the tour overly serious or strict; ensure a balance of learning and enjoyment.

  

Important Travel Information

· Connecting Flights: If your flights involve different airlines, you may need to collect and re-register your luggage at connecting hubs.

· Hotel Security Deposit: Hotels may require an advance or security deposit upon check-in, which will be refunded at checkout, minus any charges for mini-bar items, late checkout, or damages.

· Unused Nights/Early Checkout: There will be no refunds for unused nights or early check-outs, except in cases of medical conditions, which are subject to hotel policy.

· Hotel Check-in/Check-out: Check-in and check-out times are determined by hotel policies. Early check-in or late check-out is subject to availability and may incur additional charges from the hotel.

· Personal Expenses: The tour price does not cover personal expenses such as laundry, phone calls, room service, alcoholic beverages, mini-bar charges, tips, portage, or camera fees.

· Itinerary Modifications: Travel Dates reserves the right to modify the itinerary due to unforeseen circumstances, including but not limited to force majeure events, strikes, festivals, weather, traffic, overbooked accommodations/flights, flight cancellations/re-routing, or entry restrictions. While we will endeavor to make suitable alternate arrangements, we are not liable for any refunds or compensation claims arising from such modifications.

· Flight Cancellations: In the event of a flight cancellation, Travel Dates is not obligated to provide alternate flights at the same cost; any additional expenses incurred will be borne by the traveler.

· Mandatory Gala Dinners: Stays on December 24th, December 31st, or February 14th may incur additional mandatory Gala Dinner charges, payable directly to the hotel.

· Cancellation Fee: A 100% cancellation fee is applicable on the Net Tour Price (per person).

  

Our Role as Tour Organizers

Travel Dates acts solely as a tour organizer, responsible for inspecting and selecting the services provided to you. We do not own, operate, or control any airlines, shipping companies, coach services, hotels, transport, restaurants, or other service providers involved in your tour.

Therefore, please note the following:

· Adherence to Service Provider Rules: You must adhere to the conditions, rules, and regulations of each service provider (e.g., airline baggage rules, hotel meal times). Travel Dates is not responsible or liable for consequences arising from your breach of such rules.

· Participant Liability for Damages: If you cause any injury or damage affecting a service provider, you may be liable to that provider. Should the service provider recover any monies from Travel Dates for such injury or damages, we will separately charge you for the same amount.

· Exclusion of Liability: Travel Dates cannot be held responsible or liable for any delay, deficiency, injury, death, loss, or damage resulting from the act or default of such service providers, their employees, or agents.
